Yesterday, Trump’s Department of Justice stepped in to help Elon Musk's xAI avoid accountability for alleged violations of the Clean Air Act.

Not by arguing that xAI followed the law, but by arguing that the government should be able to stop communities from suing polluters in the first place and that national security does not include stopping environmental harms in communities.

That's dangerous.

The NAACP sued xAI over its operation of dozens of unpermitted gas turbines, now almost 60 on site, tied to its massive data center project near Memphis — pollution that threatens the health of Black communities and families across the region.

Now, the DOJ is backing an argument and a trillionaire that could weaken one of the most important tools communities have to hold polluters accountable: citizen lawsuits.

If powerful corporations can get special treatment, what happens to everyone else?

At a time when the ultra-rich seem to be protected by some of our government institutions, polluting industries should not get to profit at the expense of Black communities' health.

The NAACP is fighting back in court. But this fight will take resources.
