President Trump and GOP leadership have been pushing to renew one of the federal government's most controversial surveillance powers, Section 702 of the Foreign Intelligence Surveillance Act (FISA)—which has given the FBI and other agencies a backdoor to spy on Americans without a warrant, without oversight, and without limits.
And with AI advancing rapidly, the dangers are about to explode.
Thousands of Color Of Change members have added their voices to speak out against this dangerous bill and government overreach. Public opposition and Republican in-fighting has successfully stopped Congress from passing FISA's long-term renewal so far—seven Senate Republicans joined Democrats to vote against advancing it to a final floor vote, and FISA officially expired on June 12th.
But since Trump is dead set on renewing FISA, GOP leadership has promised they will keep trying to push it across the finish line.
Democrats stated that they would oppose the bill as long as Bill Pulte, a MAGA ally with zero intelligence experience, was serving as the acting Director of National Intelligence due to concerns about how he would weaponize the intelligence community against the president's opponents. But the political calculus is about to shift—Trump's new nominee for the Director of National Intelligence, Jay Clayton, has a confirmation hearing this Wednesday, which Republicans are counting on as the key to unlocking Democratic support for FISA.

Section 702 is intended to make it easier for intelligence agencies to spy on foreign terrorists, allowing agencies to sweep phone calls, texts, and emails between people in the U.S. and those abroad. But in reality, what it means is that if you’re texting a friend or relative overseas, your words can end up in secret government databases. And once the government has this information, federal agents can perform backdoor searches, even on American citizens, without a warrant.
We’ve seen the consequences of this civil rights crisis play out in real time as the government performs these searches on Black Lives Matter protesters, members of Congress, campaign donors, and even a judge who reported civil rights violations to the FBI! And now, with AI advancing rapidly, the dangers are about to explode as the mistakes, false positives, and biases we already know exist in law enforcement accelerate.
Right now, as the Republican party struggles to find a path forward to reauthorize this dangerous bill and turns to Democrats for help, we still have time to stop Congress from renewing it. But it’s going to take massive grassroots pressure to pull it off.
